INDIRECT TAXATION


The tax regime of India is complex and dynamic. With the ever-changing tax scenario, there is bound to be a difference of opinion on the applicability of tax leading to tax disputes. We keep abreast of the ever changing tax system and provide holistic tax solutions in various areas of indirect taxation while doing business with and in India through advisory, litigation and representational services.

We provide consultancy services that encompass guidance, clarification, solutions and opinions to our clients in indirect tax laws such as GST, Customs, Central Excise, Service Tax, FEMA and allied laws. We use combined years of experience to advice our clients about transactions and represent them by responding to show cause notices at the Departmental level and then pursuing their cause before the Tribunal, High Court and Supreme Court, should the need arise.

The advocates and consultants of our Chambers have multiple reported judgements where they have successfully prevailed against the Department of revenue. In addition to the adjudication proceedings determining tax liabilities, we have also represented the clients against Directorate of Revenue Intelligence as well as Department of Customs and Central Excise in criminal prosecutions for bail as well as for trial.

MEDIATION


Legal disputes of any kind can be incredibly complicated, and if you are in the midst of a disagreement, a mutually beneficial resolution may seem impossible. You could even feel that your only option is a long court case. While at our Chambers, we do provide strong representations and submissions to protect the interest of our clients, we feel that whenever there is an ongoing relationship, using litigation to fight the other side is not always the best choice.

We know that litigation is not always the answer and believe that the term ADR should not only imply alternative dispute resolution but Appropriate Dispute Resolution. One such manner of conflict resolution is Mediation. It is a flexible and confidential process used to resolve disputes between two or more people, businesses or organisations.

Mediation is recognised under various laws in India including the Civil Procedure Code, the Consumer Protection Act and the Commercial Courts Act, amongst others. Moreover, it can be one of the methods of dispute resolution incorporated in a commercial contract. Mediation is preferred worldwide for its speed, affordability and neutrality.

CRIMINAL LAW


Indian Criminal Laws are divided into three major acts i.e. Indian Penal Code, 1860, Code of Criminal Procedure, 1973 and Indian Evidence Act, 1872. Besides these major acts, special Criminal Laws are also passed by the Indian Parliament i.e. NDPS, Trademark, Copyright, Prevention of Corruption Act, Food Adulteration Act, Dowry Prohibition Act, Arms Act, POCSO etc. Thousands of minor laws exist in India and sometimes it can be difficult to navigate through all of them.
